1. Acceptance of Terms

By accessing or using the ChiCity Digitals website (chicitydigitals.com) or engaging our photography services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services

ChiCity Digitals provides professional photography services including but not limited to:

  • Nightlife and event photography
  • Hip-hop culture and street style photography
  • Personal branding and content creation
  • Portfolio and promotional shoots
  • Custom photography packages

Services are provided subject to availability and booking confirmation. We reserve the right to refuse service to anyone for any lawful reason.

3. Booking and Payment

Booking

  • All bookings must be confirmed in writing (email or contract)
  • A deposit may be required to secure your booking date
  • Session details (date, time, location) must be confirmed at least 48 hours in advance

Payment

  • Payment terms will be outlined in your service agreement
  • Full payment is typically due before or immediately after the session
  • We accept payment via cash, digital payment platforms, or bank transfer
  • Late payments may result in delayed delivery of final images

4. Cancellation and Rescheduling

By Client

  • Cancellations made 7+ days before the session: Full refund of deposit
  • Cancellations made 3-6 days before: 50% deposit refund
  • Cancellations made less than 3 days before: No refund
  • Rescheduling is available with at least 48 hours notice (one-time only)

By ChiCity Digitals

We reserve the right to cancel or reschedule due to unforeseen circumstances (illness, weather, emergencies). In such cases, you will receive a full refund or the option to reschedule at no additional cost.

5. Copyright and Usage Rights

Our Rights

ChiCity Digitals retains full copyright to all photographs and images created during sessions. We reserve the right to use images for:

  • Portfolio showcase and promotional materials
  • Social media marketing
  • Website display
  • Professional competitions and exhibitions

Your Rights

Upon full payment, you receive a personal license to:

  • Use images for personal, non-commercial purposes
  • Share on personal social media accounts (with credit)
  • Print for personal use

Commercial usage requires written permission and may incur additional fees.

Restrictions

  • You may not sell, redistribute, or sublicense the photographs
  • You may not alter images without permission (excluding basic filters)
  • Credit to ChiCity Digitals is appreciated when sharing publicly

6. Image Delivery and Timeline

  • Edited images are typically delivered within 1-3 weeks of the session
  • Rush delivery may be available for an additional fee
  • Images are delivered digitally via secure download link or cloud storage
  • You are responsible for downloading and backing up your images
  • We are not responsible for lost or deleted files after delivery
  • Images are stored on our servers for 90 days after delivery

7. Client Responsibilities

As a client, you agree to:

  • Arrive on time for scheduled sessions
  • Provide accurate information about session requirements
  • Obtain necessary permits or permissions for shoot locations
  • Ensure all participants have consented to being photographed
  • Behave respectfully toward the photographer and others during the session
  • Comply with venue rules and regulations

8. Limitation of Liability

ChiCity Digitals is not liable for:

  • Equipment failure or technical malfunctions beyond our control
  • Injuries or accidents during photo sessions
  • Loss or damage to personal property
  • Third-party actions or venue-related issues
  • Weather-related cancellations or delays

Our liability is limited to the amount paid for services. We carry professional liability insurance for our photography work.

9. Intellectual Property

All content on the ChiCity Digitals website, including text, graphics, logos, images, and software, is the property of ChiCity Digitals and protected by copyright laws. You may not reproduce, distribute, or use any content without written permission.

10. Website Use

When using our website, you agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Upload malicious code or viruses
  • Scrape or copy content without permission
  • Interfere with the website's functionality
  • Impersonate ChiCity Digitals or our representatives

11. Model Release

By booking a session, you grant ChiCity Digitals permission to use your likeness in photographs for promotional purposes unless otherwise agreed in writing. If you prefer your images not be used publicly, please notify us before the session, and we will honor your request.

12. Dispute Resolution

In the event of a dispute, we encourage clients to contact us directly to resolve the issue amicably. If a resolution cannot be reached:

  • Disputes will be governed by the laws of the State of Illinois
  • Any legal proceedings must be filed in Cook County, Illinois
  • Both parties agree to attempt mediation before litigation

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
